Subscription fees are billed in advance and must be paid by the due date. Failure to make payment may result in suspension or termination of your account. Unless required by applicable law, subscription fees are non-refundable.
Where available, free trials are provided for a limited period. At the end of the trial, access to the platform may be restricted until a paid subscription is activated.
You are solely responsible for your products, services, pricing, taxes, customer support, shipping, returns and compliance with all applicable laws. EssenceCart is not a party to transactions between merchants and their customers.
You agree not to use EssenceCart to engage in unlawful, fraudulent or harmful activities. This includes selling illegal products, distributing malware, sending unsolicited communications, infringing intellectual property rights or violating any applicable laws. EssenceCart reserves the right to suspend or terminate accounts that breach these Terms.
EssenceCart may provide AI-powered tools including content generation, image generation and other AI-related services. AI-generated content should always be reviewed before publication. While we strive to provide useful results, EssenceCart does not guarantee the accuracy, completeness or originality of AI-generated content. AI usage may be subject to limits depending on your subscription plan.
EssenceCart may integrate with third-party services such as payment gateways, shipping providers, live chat platforms, marketing tools and other software. Your use of these services is governed by their own terms and policies. EssenceCart is not responsible for the availability, performance or actions of third-party providers.
Themes and plugins may be developed by EssenceCart or third-party developers. While we make reasonable efforts to ensure compatibility, we do not guarantee that all third-party themes or plugins will function without interruption or conflict.
Payment gateways operate independently from EssenceCart. Unless expressly stated, EssenceCart does not process or hold customer funds. All payment disputes remain between the merchant, customer and the applicable payment service provider.
EssenceCart may allow merchants to connect their stores with third-party marketplaces and sales channels. Availability of these integrations depends on the respective providers and may change without notice. EssenceCart does not guarantee uninterrupted connectivity or functionality.
EssenceCart may facilitate introductions between merchants and retail property owners for pop-up stores or other retail opportunities. All applications remain subject to the approval processes of the property owner. EssenceCart does not guarantee approval, is not a party to any lease agreement and accepts no responsibility for rental arrangements or business outcomes.
EssenceCart retains all rights, title and interest in its software, platform, branding, logos, designs and related intellectual property. You retain ownership of your own content, including your products, images, logos, customer data and store content.
Our collection and use of personal information is governed by our Privacy Policy. By using EssenceCart, you consent to the collection, processing and storage of information necessary to provide the Services.
We aim to provide reliable access to the platform but do not guarantee uninterrupted or error-free service. Maintenance, updates or unforeseen events may occasionally affect availability.
While EssenceCart performs routine system backups, merchants are encouraged to maintain their own backups of important data. We cannot guarantee recovery of all data in every circumstance.
To the maximum extent permitted by law, EssenceCart shall not be liable for any indirect, incidental, consequential or special damages, including loss of profits, revenue, business opportunities or data arising from your use of the Services. Our total liability shall not exceed the subscription fees paid by you during the twelve months preceding the claim.
You agree to indemnify and hold harmless EssenceCart, its employees, directors and affiliates from any claims, liabilities, damages or expenses arising from your use of the Services, your products or services, your content or your breach of these Terms.
EssenceCart reserves the right to suspend or terminate accounts that violate these Terms, engage in unlawful activity, compromise platform security or fail to pay subscription fees. You may cancel your subscription at any time, subject to any applicable notice requirements.
We may add, modify or discontinue features, services or functionality at any time to improve the platform or comply with legal or operational requirements.
EssenceCart may update these Terms from time to time. Updated versions become effective upon publication on our website or platform. Continued use of the Services constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.
